Arizona Fireworks Law And Business Self Regulation
Arizona recently passed a new fireworks bill into law allowing so-called “consumer grade” fireworks to be sold beginning Dec. 1. This would allow Arizona citizens the ability to purchase sparklers. The new law still does not permit the use or sale of Roman candles or other fireworks intended to rise into the air.
David M Cantor, Phoenix DUI Lawyer, points out that the fireworks industry has come together on their own to work with cities that have not yet planned how sales of fireworks will be regulated. This is a notable instance of businesses self regulating themselves to help put the community in a comfortable situation.

  1. Do cities really have the authority to tell people what they can and cannot do on private property? Where do property rights and city intrusion overlap? I can see them banning the use on city property for liability reasons, but not my lawn.

  2. @capnfucker I see what you mean. But, that’s like saying can’t I do meth on my lawn it’s private property. It’s because the laws overlap that. Like you use to be able to drive in the forest up in the mountains without a license as long as you aren’t on the road. They changed it so it’s against the law now. You can’t drive a car without a license on your property or in the forest in state of Arizona now.

  3. @JarrJarrAlchemist Your response doesn’t add up to what I’m asking, I’m replying to you then I’ll wait to see if the ATTY responds. Since meth is illegal you should not be able to do it anywhere, but fireworks are legal! So how can they criminalize something that is legal?

  4. Guess David Cantor doesn’t know. I was hoping to hear what an ATTY has to say on the matter. Oh well.
